1. DEFINITIONS In these Booking Conditions, “I” and “me” mean the Organizer

• a. “You” and “your” mean the participant.
• b. “The Study Day” refers to the accommodation and activities as detailed in the attached itinerary.
• c. “The IDS” means the International Dendrology Society.

2. PAYMENT You shall pay to me the full price of the Study Day in accordance with the payment terms specified on the booking form.

3. FLIGHTS AND TRAVEL ARRANGEMENTS You must organise and pay for flights or any other travel to and from the Study Day. These are not my responsibility, nor am I responsible for refunds if for any reason you do not travel. You should arrive at the place, date and time as detailed in the itinerary. No refund will be given for any part of the Study Day missed in such circumstances. Depending on your nationality, you must ensure you have a passport valid for more than six months at date of travel, and any necessary visa. You must at all times be able to handle your own luggage as assistance may not be available.

4. INSURANCE You are responsible for taking out your own appropriate travel insurance in respect of the Study Day. I have to require you to do so, and without it you will not be able to join the Study Day.

5. CANCELLATION If you cancel your booking your deposit will be forfeited and you must reimburse me in respect of all costs incurred directly or indirectly as a result of your cancellation.

6. ALTERATION BY ME/CANCELLATION BY ME As you will appreciate, the arrangements for the Study Day are planned many months in advance and on rare occasions it may be necessary to make modifications to them. I reserve the right to make such changes at any time. I am not liable if I have to cancel the Study Day or make a substantial change to it by reason of war, terrorist action, riots, industrial action, natural or nuclear disaster, fire, adverse weather conditions, closures of airports or ports, prohibitive government action or other events beyond my control. In such circumstances the amount of any refund will be decided by the IDS Science and Education Committee and the Arboretum Kalmthout. A Deputy Organizer is appointed in case of my being unable to participate.

MISCELLANEOUS

7. I exclude my liability to the fullest extent permitted by law for loss or damage suffered by you or occurring to any items belonging to you while you are on the Study Day.

8. While on the Study Day you may not collect seeds or take cuttings in gardens or arboreta without first obtaining the permission of the owner. You may only collect native plant material in accordance with the biodiversity laws of that country. You will be liable for any damage that you cause.

9. While on the Study Day you may not take photographs for commercial purposes without the prior agreement of the owner.

10. The booking of the Study Day constitutes a contract between you and me. I am entirely responsible for the Study Day. The IDS is not a party to the contract. You acknowledge that the IDS and the Arboretum Kalmthout have no liability for any loss or damage you may suffer directly or indirectly in connection with the Study Day or the contract made between you and me.

11. Any complaints you may have about the way I have organized or run the Study Day that you feel I have not adequately dealt with should be communicated to the Chairman of the Science and Education Committee of the IDS. Nothing in this clause affects the operation of Clause 10 above.

12. These conditions shall be construed solely in accordance with the laws of England. Any disputes arising from these conditions shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales.
